Serbia: Legal Expert – education of vulnerable groups

Purpose of Activity/Assignment:

Purpose of the assignment is to support UNICEF in defining suggestions for the improvement of the set of laws in Education which are expected to be proposed in the forthcoming period, as well as to support the Ministry of Education, Science and Technological Development (MoESTD) in developing bylaws related to education of vulnerable groups (such us refugee and migrant children in Serbia), as well as revising the Rulebook on Specific Criteria for Identifying Forms of Discrimination by Employees, Students or Third Parties in Education Institutions.

Ministry of Education, Science and Technological Development has been working on comprehensive revisions of the Law on Foundations of the Education System and the public debate have been conducted in period Maj-June 2017. The framework law governing education has yet to be adopted, but bearing in mind the proposed changes it is expected that MoESTD will propose amendments on set of Laws in the forthcoming period: Law on Preschool Education, the Law on Elementary Education and the Law on Secondary Education.

UNICEF has provided technical support to MoESTD and the Commissariat for Refugees and Migrations to develop a strategic approach to the education of refugee and migrant children based on the review of international practices and contextualised to the situation in Serbia which includes access to education, both through inclusion in mainstream education and through provision of non-formal learning opportunities in Government centres. The Ministry of Education, Science and Technological Development has recently defined the Concept of education of refugee and migrant children and Guidelines for non-formal education in Asylum/ Transit and Reception centres. Next priorities will include drafting/developing articles and sub-articles to the existing and new laws and bylaws that are relevant for improvement of education of refugee and migrant children as well as developing the National School Welcome Programme. The proposed changes required a thorough review of to ensure that they are written into legal form, that articles and sub-articles are properly written and placed into proper sections of the Laws or bylaws.

The Minister of Education, Science and Technological Development (MoESTD) and the Minister of Public Administration and Local Government jointly issued the Rulebook on Specific Criteria for Identifying Forms of Discrimination by Employees, Students or Third Parties in Education Institutions (Rulebook). To ensure the full implementation of the Rulebook, the MoESTD in cooperation with the Commissioner for Protection of Equality and UNICEF has implementing the project “Support to Implementation of Regulations related to Anti-discrimination in Education System”, aiming to define the measures to be taken or the manners of conduct in case of acts of discrimination through preparation and to strengthen the capacity of education system for improvement and implementation of the antidiscrimination by-laws. During the previous period, the MoESTD established the Working Group and initiated the process of preparation of the tools and mechanism to prevent, detect and respond to discrimination act. In order to finalize and wrap up proposed tools and mechanism and draft new revised Rulebook, aligned with other laws in education (primarily with the Law on Foundations of Educational System and the Anti-discrimination Law), additional support of the Consultant is needed.

Consultant’s assignment is to review proposals and suggestions from relevant stakeholders, and to translate suggestions into legal forms and define/write bylaws and related articles and sub-articles.

Number of working days/months Estimated 15 days over three months period (paid on actual days worked)

Work Assignment Overview

Task 1: Developing draft version of the new Rulebook on Specific Criteria for Identifying Forms of Discrimination by Employees, Students or Third Parties in Education Institutions with included measures related to response in case of act of discrimination.

This will require to:

- review materials developed by the Working Group and engaged consultants of the MoESTD related to procedures, tools and mechanism to detect and respond to discrimination;

- based on the inputs from the WG prepare draft version of the revised Rulebook, with integrated procedures, tools and mechanism;

The consultant is expected to complete this task through participating in the meetings with the Working group of the MoESTD when needed. It is expected that proposals submitted by the consultant are aligned with national legislation on antidiscrimination.

Deliverables:

• The draft version Rulebook on Specific Criteria for Identifying Forms of Discrimination by Employees, Students or Third Parties in Education Institutions with procedures, tools and mechanism to detect and respond to discrimination prepared

Timeframe: 5 days in the period September – November 2017

Task 2: Review proposals for the set of Laws (Law on Preschool Education, the Law on Elementary Education and the Law on Secondary Education), expected to be amendment in the forthcoming period, prepare legal suggestions and define articles and their placement

Deliverables: Set of articles and legal suggestions for the set of Laws in education

Timeframe: 3 days in the period September – December 2017

Task 3: Prepare inputs/Guidelines related to the education of migrant and refugee children in Serbia (articles on school evidences, enrolment etc). The consultant is expected to complete this task through participating in the meetings with relevant stakeholders and the MoESTD when needed.

Deliverables: Short guidelines on specific issues related to education of migrant and refugee children in Serbia prepared

Timeframe: 7 days in the period September 2017

Minimum Qualifications required: Bachelors - University degree in Law is required

Knowledge/Expertise/Skills required:

• At least 10 years of experience in drafting legislation is required, preferably in the field of education;

• Sound judgement is required in a follow-up on request; high degree of accuracy is important;

• Good analytical and communication skills;

• Ability to meet tight deadlines through excellent time management and organization;

• Excellent oral and written Serbian language skills;

• Work experience with UNICEF and /or other international organizations would be considered as an advantage.
