Purpose of Activity/Assignment:
Purpose of the assignment is to support UNICEF and the Ministry of Education, Science and Technological Development (MoESTD) in developing bylaws related to education of vulnerable groups and development of the information system in education, which are expected to be prepared in the forthcoming period.
The Ministry of Education, Science and Technological Development had been working on comprehensive revisions of the Law on Foundations of the Education System and the new Law has been adopted in September 2017 (Official Gazette of RS, No. 88/17), followed by adoption of the Law on Preschool education, the Law on Elementary Education and the Law on Secondary Education.
The Law on Foundations of the Education System articulated the need to develop by-laws which should regulate further development of the information system in education, more specifically the by-law on a Unique Education Number and by-laws related to data collection through registries of institutions, employees and children, pupils, adults and students in the education system.
Following the legal revision in the previous period, within the project Supporting implementation of antidiscrimination regulative framework in education the MoESTD established the Working Group, initiated the process of preparation of the procedures, tools and mechanism to detect and respond to act of discrimination or segregation in education and prepared draft version of the Rulebook on Conduct of Education Institution in case of suspicion or determined Act of Discrimination. In order to finalize and wrap up proposed tools and mechanism and adopt the new Rulebook, aligned with other laws in education (primarily with the Law on Foundations of Educational System and the Anti-discrimination Law), additional support of a Consultant is needed. At the same time, the MoESTD established working groups for development of two other Rulebooks, relevant for education of vulnerable groups “ the Rulebook on Individual Education Plan for the Child and Pupil and the new Rulebook on Additional Educational, Health and Social Support to the Child and Pupil and on the work of Intersectoral Committees.
Given the scope and number of new by-laws, additional support of a legal consultant will be required to support the work of working groups of the Ministry. Consultants assignment is to review proposals and suggestions from relevant stakeholders, and to translate suggestions into legal forms and define/write by-laws and related articles and sub-articles.
The initiative will be implemented under the Joint Programme for Roma and Marginalised Groups Inclusion, Phase III, supported by the Swiss Agency for Development and Cooperation.

Work Assignment Overview

Timeframe: 20 days in the period from February - June 2018
Task 2: Developing final version of the Rulebook on Conduct of Education Institution in case of suspicion or determined Act of Discrimination
This will require to:
-review materials developed by the MoESTD Working Group related to procedures, tools and mechanism to detect and respond to act of discrimination or segregation in education;
-align proposals for the Rulebook with national legislation on antidiscrimination;
-based on the inputs received from the MoESTD WG and from other relevant stakeholders, prepare final version of the Rulebook.
Deliverables: Final version of the Rulebook on Conduct of Education Institution in case of suspicion or determined Act of Discrimination, with procedures, tools and mechanism to detect and respond to discrimination prepared
Timeframe: 7 days in the period February-March 2018
Task 3: Support MoESTD in developing the new Rulebook on Individual Education Plan for the Child and Pupil and the new Rulebook on Additional Educational, Health and Social Support to the Child and Pupil and on the work of Intersectoral Committees
This will require to:
-review materials developed by the inter-ministerial Working Groups, coordinated by the MoESTD;
-align proposals for the Rulebooks with national legislation on inclusive education;
-based on the inputs received from the Working Group and from other relevant stakeholders, prepare final version of the two Rulebooks.
Deliverables:
Final version of the Rulebook on Individual Education Plan for the Child and Pupil prepared
Final version of the Rulebook on Additional Educational, Health and Social Support to the Child and Pupil and on the work of Intersectoral Committees
Timeframe: 13 days in the period February - July 2018
Minimum Qualifications required:
BA University degree in Law is required
Knowledge/Expertise/Skills required:
At least 7 years of experience in drafting legislation is required, preferably in the field of education;
Familiarity with the legislation in the field of education;
Sound judgement is required in a follow-up on request; high degree of accuracy is important;
Good analytical and communication skills;
Ability to meet tight deadlines through excellent time management and organization;
Excellent oral and written Serbian language skills;
Work experience with UNICEF and /or other international organizations would be considered as an advantage.
